# Section 5: Property Classifications

### [5.1 – Mandatory Submission (Property Types Subject to CCP)](#id-5.1-mandatory-submission-property-types-subject-to-ccp) 🟦

Unless the MLS receives a seller-signed [**Office Exclusive Disclosure**](/section-6-multiple-listing-options-for-sellers-and-ccp-compliance-nar-policy-8.00.md#download-the-office-exclusive-disclosure), entry in the MLS within three (3) business days of the listing agreement start date is mandatory for the following property types when all three criteria are met:

✅ The residence includes four (4) units or less and is available for occupancy upon closing. “Available for occupancy” means the dwelling is in livable condition at the time of listing. Properties actively under construction or renovation, or otherwise not habitable at the time of listing, are not considered available for occupancy for purposes of mandatory submission.

#### [A. The Clear Cooperation Policy (“CCP”)](#clear-cooperation-policy-ccp-quick-explanation) 🟦

The Clear Cooperation Policy ("CCP") governs how listings subject to mandatory submission must be handled when publicly marketed. **For the full definition of CCP** — including what triggers the one (1) business day filing requirement, what constitutes public marketing, and the corrective actions required upon a violation — see the [**Clear Cooperation Policy (“CCP”) Violation and Repercussions**](https://rulebook.bscmls.com/pages/Ly52oj7Jm1RUXjXdk2ur#id-6.6-clear-cooperation-policy-ccp-violation-and-repercussions-nar-policy-8.00).

**In short:** if a listing that is subject to the rules of CCP is publicly marketed in any way, it must be filed with the MLS within one (1) business day. Seller choice of private marketing (Office Exclusive) is honored only so long as marketing behavior remains consistent with the option selected. CCP is about how the listing is marketed, not just the seller's preference.

#### [B. Residential Classifications](#residential-classifications)

**Single-Family:**

A detached structure used as a single dwelling unit.

**Modular vs. Manufactured Homes:**

* **Modular Homes** are built in factory-made sections, transported to the site, and assembled on a permanent foundation. Because they are generally built to the same state and local building codes as traditional site-built homes, they may be classified as **Single-Family** in the MLS.
* **Manufactured Homes** are different. They are built to the federal HUD construction standard, not the local building code, and may be classified in the **Residential** class only when they are being conveyed as real property with the land and no separate title remains in effect. If a separate title still exists, or the land is not included in the transfer, the home is not being conveyed as real property.

* [x] Must select “Detached” in the ADU Features. Square Footage WILL NOT be included in the home’s gross living area because it is a separate dwelling requiring an exterior entrance and separate amenities. This distinction follows ANSI standards and is crucial for appraisals and accurate property valuation. To be considered as gross living area, the structure needs to be connected to the house and accessible through the house.

**Condominium:**

Individually sellable units where the land/common areas are jointly owned.

Attached dwellings sharing side walls; owners typically own the footprint.

**De-titled Manufactured Home:**

Prefabricated housing built AFTER June 15, 1976 (HUD Code). Must be on a permanent foundation and de-titled to be entered as Residential. (Mobile homes built *before* 1976, or those not on permanent foundations, must be listed under Land with Mobile/Manufactured Home).

Properties with multiple dwellings (e.g., 2 cabins on one lot, or multiple apartment units)

**Individual Sale vs. Bulk Sale:** If the building serves as one legal description (e.g., a standard duplex), it must be listed as Multifamily. It cannot be split into Residential listings. If units have been legally converted to condos/townhomes (individual Parcel IDs), they may be listed individually in Residential AND as a “Bulk Sale” in Multifamily.

#### [D. Farm & Ranch Classifications (With Residence)](#d.-farm-and-ranch-classifications-with-residence)

Agricultural land that includes a Residential dwelling.

### [5.2 – Exempt Property Types](#id-5.2-exempt-property-types)

The following property types are Exempt from CCP (see [**Clear Cooperation Policy (“CCP”) Violation and Repercussions**](https://rulebook.bscmls.com/pages/Ly52oj7Jm1RUXjXdk2ur#id-6.6-clear-cooperation-policy-ccp-violation-and-repercussions-nar-policy-8.00)), and the Office Exclusive Disclosure Form is not required. **(Entry is Optional)**. If entered voluntarily, the listing must still follow all MLS content, accuracy, and status reporting rules.

### [5.3 – Prohibited Property Types](#id-5.3-prohibited-property-types)

The following classifications are ineligible for entry in the BSCMLS. Listings found to contain these prohibited types may be removed immediately by MLS Staff and are subject to enforcement under [**Section 16.2 - Category 2 # 2**](/section-16-mls-policy-and-enforcement.md#category-2-operational-and-administrative-compliance) ("Non-Correctable “Event” Violations").

Listings that do not convey an interest in real property are prohibited.
