# Section 10: Listing Statuses & Protocol

### [10.1 – Status Definitions](#id-10.1-status-definitions)

The statuses in this section describe the listing’s contractual and showing availability. The seller’s visibility election (Open Market, Delayed Internet Advertising, or Office Exclusive) is governed by [**Section 6**](/section-6-multiple-listing-options-for-sellers-and-ccp-compliance-nar-policy-8.00.md).

#### [A. ON-MARKET STATUSES](#on-market-statuses)

DOM & CDOM accrue; listings automatically expire on the negotiated expiration date. <summary><strong>Active:</strong></summary>

The property is available for showings and has no accepted offers or unresolved contingencies.

<details>

<summary><strong>Active-Property Sale Contingency:</strong></summary>

An active listing where the Seller has accepted an offer contingent on the sale of the Buyer’s property, but the Seller retains the right to continue marketing and accept other offers.

* **The “Kick-Out” Clause:** If a secondary offer is accepted, the primary buyer is given a set timeframe (typically 48-72 hours) to either waive their contingency or withdraw from the contract.

#### [B. OFF-MARKET STATUSES](#b.-off-market-statuses)

DOM & CDOM do NOT accrue.

<summary><strong>Contingent Backups OK:</strong></summary>

The Buyer and Seller have signed a purchase agreement, but the sale is subject to specific conditions being met (e.g., inspection, appraisal, financing). Back-up offers may still be accepted. The Contract Date must reflect the date the final signature was obtained.

* Listings in this status will NOT expire automatically.
* The Proposed Closing Date must be kept current.

<summary><strong>Under Contract:</strong></summary>

The Seller has accepted an offer, and the sale is moving toward closing. All major terms are agreed upon. The Contract Date must reflect the date the final signature was obtained.

* Listings in this status will NOT expire automatically.
* The Proposed Closing Date must be kept current.

<details>

<summary><strong>Temporarily Off-Market:</strong></summary>

The Seller has requested a temporary suspension of showings and marketing (e.g., for repairs, privacy, or illness).

1. The property cannot be shown by anyone.
2. If a showing occurs, the status must be changed back to Active within one (1) business day.
3. Existing signage may remain, but no new public marketing may occur.
4. When a listing is changed to TOM status, the MLS system will automatically suppress IDX and syndication distribution.
5. The Change of Status to TOM form must be submitted to the BSCMLS by 11:59 PM on the third business day following the status change.
6. The MLS system will allow a listing to be set as TOM only once per listing term unless MLS Staff approves a rare exception based on written seller instruction.

These statuses *may* imply the business relationship regarding the specific listing record has ended.

<summary><strong>Expired:</strong></summary>

The listing agreement term has ended.

**Renewing Expired Listings:** If a listing expires in the MLS, but the Listing Agent receives a valid written extension from the seller **ON OR BEFORE** the original agreements expiration date, the agent must submit the amendment / extension document to MLS Staff within three (3) business days of the seller’s signature. MLS Staff will manually reactivate the listing to an Active status, retaining all the original listing distribution options for internet display.

**Note on CCP Compliance:** Holding a signed extension for an expired MLS listing while continuing to market the property is a violation of the Clear Cooperation Policy. If public marketing continues, the listing must be reactivated/entered in compliance with CCP within one (1) business day.

<summary><strong>Canceled/Terminated:</strong></summary>

The listing agreement is terminated prior to the expiration date. Requires written documentation signed by both the Seller and the Listing Broker (or an authorized licensee acting on the Broker’s behalf).

* ***Duplicate Listings:*** See [**Category 1 Violations # E**](/section-16-mls-policy-and-enforcement.md#category-1-data-integrity-and-content-standards) for required actions upon closing a property entered in multiple categories.

**Prohibition:** A listing cannot be Canceled/Terminated while in an Under Contract or Contingent, Backups OK status to avoid reporting sales data.

**Note on Solicitation of Canceled & Terminated Listings:** While the “Canceled/Terminated” status may imply the termination of the MLS listing, it does not definitively confirm the termination of the underlying listing agreement. Sellers may elect to remove a property from the MLS system (while it is still an On-Market status) for privacy or other strategic reasons while maintaining a valid, active listing agreement with the original Brokerage. Subscribers are cautioned that a change to “Canceled” status is not proof of a voided contract. Prior to contacting a seller whose property appears in this status, Subscribers must affirmatively verify that the listing agreement has been terminated to avoid interference with an ongoing agency relationship.

<summary><strong>Sold:</strong></summary>

The transaction has closed/recorded.

* **Concessions:** These are monetary contributions provided by the Seller to the Buyer to cover costs associated with purchasing the property. Seller concessions must be reported in the Sales Details.

<summary><strong>Leased:</strong></summary>

The property has been leased/rented.

</details>

All listing changes must be updated in the MLS within three (3) business days, except for CCP violations, which must be resolved within one (1) business day.

**Contingency Updates**

Any change to contingencies or contract terms that affects the listing’s status or availability (including fulfillment, extension, cancellation, or removal of contingencies) must be updated in the MLS within the same timeline required for status changes under this section.

**Seller Rights**

MLS cancellation requires written instruction consistent with the listing agreement; if the seller claims termination, proof of contract termination is required.

**Transition to Office Exclusive**

If a seller directs that an Active listing be changed to Office Exclusive, a seller-signed Office Exclusive Disclosure must be submitted to the BSCMLS office within three (3) business days of the change, and the Listing Agent must retain a copy in the brokerage file. If the seller chooses [**On-MLS Office Exclusive**](/section-6-multiple-listing-options-for-sellers-and-ccp-compliance-nar-policy-8.00.md#on-mls-office-exclusive), the listing may remain in the MLS with visibility limited to the listing office as permitted by Section 6. If the seller chooses [**Off-MLS Office Exclusive**](/section-6-multiple-listing-options-for-sellers-and-ccp-compliance-nar-policy-8.00.md#off-mls-office-exclusive), the listing may be removed from the MLS and withheld for as long as the seller directs, whether temporarily or indefinitely. In either case, the listing must remain private and comply with [**Section 6**](/section-6-multiple-listing-options-for-sellers-and-ccp-compliance-nar-policy-8.00.md).

**Expiration**

Listings are removed automatically on the expiration date. Reactivation requires an amendment signed *prior* to the original expiration.
