### [1.1 – Timekeeping (Applies to Entire Handbook)](#id-1.0-timekeeping-applies-to-entire-handbook)

Unless otherwise stated, all actions required for a listing to remain in compliance must occur within three (3) business days (Monday-Friday), excluding certain Federal holidays.

### [1.2 – Authority to Amend Rules](#id-1.1-authority-to-amend-rules) 🟦

Changes to the Rules & Regulations must be approved by the Big Sky Country MLS ("BSCMLS") Board of Directors. Certain changes may also require final approval from the Board of Directors of the Southwest Montana REALTORS® ("SMR") — the primary shareholder of the BSCMLS. All amendments to these Rules shall be communicated to Participants and Subscribers in writing (including by email) no fewer than 30 days prior to the effective date, except in emergency circumstances as determined by the Board. Emergency amendments may take effect immediately upon adoption but must be ratified at the next regular Board meeting. The BSCMLS shall conduct periodic self-certification of these Rules and Regulations pursuant to National Association of REALTORS® MLS governing document requirements, and staff shall ensure all required self-certification filings are completed by applicable NAR deadlines.

### [1.3 – Contractual Nature; Scope of Authority](#id-1.2-contractual-nature-scope-of-authority)

All rights, obligations, restrictions, and enforcement mechanisms contained in these Rules and Regulations constitute contractual terms governing access to and use of the BSCMLS system and MLS services. The BSCMLS is not a governmental body, licensing authority, or professional association. Nothing in these Rules shall be construed as regulating professional licensure, certification, or membership in any REALTOR® Association. Any suspension, termination, fine, or other sanction imposed under these Rules affects only MLS participation and access to MLS services.

### [1.4 – REALTOR® Code of Ethics; Exclusive Association Jurisdiction](#id-1.3-realtor-r-code-of-ethics-exclusive-association-jurisdiction)

REALTOR® Participants and Subscribers remain subject to the National Association of REALTORS® Code of Ethics and the professional standards, arbitration, and enforcement procedures of their primary REALTOR® Association. The BSCMLS does not interpret, enforce, or adjudicate alleged violations of the REALTOR® Code of Ethics and shall refer such matters to the Participant/Subscribers Primary REALTOR® Association.
